Mock Trial Scripts

There are a number of mock trials available for your use during the mock trial program. They are either civil or criminal.  Some trials have been scripted so all the detail is there for your students. Non-scripted trials do not have a script as the students are expected to create their own questions for the witnesses who will also prepare their own answers. These non-scripted trials may be more challenging to prepare.

Scripted Mock Trials

There are two civil and ten criminal scripted mock trials. Each trial has a detailed script of what each character will say during the trial.  These trials are suitable for all ages and can be used to illustrate the trial process to older students who will be preparing the more difficult non-scripted trials.  The scripted mock trials are based on real life scenarios, fairy tales and novel or movie characters.

Regina v. Clarke

This script is based on an actual case of Regina v. Jeremy Matthew Coles, which was decided in Surrey Provincial Court in 2000. A 19-year-old man is accused of causing the death of two people. In the script, it is alleged that Jamie Clarke wedged a stick between the accelerator and the front seat of a stolen vehicle and sent it careening through an intersection, where it crashed into a motorcycle carrying the two victims. Clarke is charged with two counts of criminal negligence causing death. The case has roles for a judge, court clerk, crown and defence counsel as well as eight witnesses.

Regina v. Girard

This script is based on a case from Manitoba: Regina vs. Lavallee. The case was decided in the Supreme Court of Canada in May 1990. In the script, Nicole Girard is charged with the second degree murder of her live-in boyfriend. For years, Girard had been violently assaulted by her boyfriend. The case has roles for a judge, court clerk, crown and defence counsel as well as seven witnesses.

Regina v. Howard

This mock trial explores a topical and controversial issue – alleged assault by a teacher on a student. The script is loosely based on the case of Regina v. Swanson, which was tried in BC Provincial Court in Masset in 1993. The case has roles for a judge, court clerk, crown and defence counsel as well as seven witnesses.

Regina v. Hudson

This script is based on the case of Kenneth Parks, which made Canadian legal history when sleepwalking was raised as a defence to murder. The case has roles for a judge, court clerk, crown and defence counsel as well as seven witnesses.

Regina v. Irving

This script is loosely based on the case of Louis Bayard, who was charged with murder arising out of an incident in Vancouver in 1986. The accused’s defence is that the killing was a justifiable act of self-defence. The case went all the way to the Supreme Court of Canada. The case has roles for a judge, court clerk, crown and defence counsel as well as seven witnesses.

Regina v. Mitchell

This fascinating and controversial case is based upon the 1986 trial of Wesley Evans, who was charged with two murders. Some persons believe that Evans, a confessed double murderer, was acquitted by the Supreme Court of Canada because of technicalities in the Charter of Rights. The case has roles for a judge, court clerk, crown and defence counsel as well as seven witnesses.

Regina v. Westerland

This script is based on the trail of D.A.E., who was charged with sexual assault in 1991. Besides encouraging students to focus on the difficult and controversial legal issues arising from this case, the script encourages thoughtful discussion on personal lifestyle choices and their effects. The topic, acquaintance rape, is both important and timely. The case has roles for a judge, court clerk, crown and defence counsel as well as seven witnesses.
